This Privacy Policy is an annex and an inseparable part of the User Contract executed with the User, and it applies when you download or use the Application or visit our Website (the “Services”). 

By visiting Our Platform and/or by providing Your information and/or by availing Our Services, You consent to the collection, storage, and use of the information You disclose on Our Platform in accordance with this Privacy Policy, including but not limited to, Your consent for sharing Your information as per this Privacy Policy. You acknowledge and agree that even if You are not a registered User with Us, We may collect information about You if a registered User has provided Us with Your information to facilitate Services.

If We decide to change Our Privacy Policy, We will post those changes on this page along with the date of change so that You are always aware of what information We collect, how We use it, and under what circumstances We disclose it. If You do not agree to the foregoing, please do not continue to use or access Our Platform.

1. Collection of Identifiable Information

We may use this information to do internal research on our User’s demographics, interests, and behavior to better understand, protect and serve our Users. This information is compiled and analysed on an aggregated basis from time to time. Please note that while providing information, there are certain mandatory fields and certain optional fields. The Users may decide whether or not to provide such information to Us. Please note the Services of the Company will only be provided when all mandatory information is provided by You. If the Company does not receive such requisite information, the Company may choose not to complete the Services.

4. We may obtain certain information through Your social media profiles or other online accounts You have permitted to be connected to the Platform. If you login to the Platform via Facebook or another third-party platform or service, we ask for Your permission to access certain information which is already given under that account, such as Your name, profile picture, account ID number, email address, location, the physical location of Your access devices, and birthday.

5. We may also obtain information through third parties, with which we have a business or legal relationship, such as business partners, technical, payment, and delivery service subcontractors, advertising networks, analytics providers or search information providers.

6. We may use this information to do internal research on Our Users’ demographics, interests, and behavior to better understand, protect and serve Our Users. This information is compiled and analysed on an aggregated basis.

7. You acknowledge and agree that the information mentioned hereinabove may be collected by Us in an encrypted format or an unencrypted format.

8. You acknowledge and agree that any data or information collected by Us is data and information that has been voluntarily provided by You. We will not be responsible for the accuracy or correctness of any such information. You undertake to indemnify Us for any losses that we may suffer due to any claim raised against Us with respect to any data and/or information that is provided by You to Us.

When you access the Services, we collect certain data by automated means, including but not limited to technical data about Your device, like Your device type, mobile operator, operating system type and version, unique device identifiers, browser, browser language, domain, and other systems data, and platform types (“System Data”); usage statistics about Your interactions with the Services, including the number of orders, types of orders, time spent on deciding what to order, pages visited, features used, Your search queries, click data, date and time, and other data regarding Your use of the Services (“Usage Data”); an approximate geographic location, including information like country, city, and geographic coordinates, calculated based on Your  IP address.

Your personal data collected hereunder may be processed;

14. as we, in our sole discretion, otherwise determine to be necessary to ensure the safety or integrity of our users, employees, third parties, the public, or our Services.

3. Whom Do We Need to Share Your Information With?

By using our Services You give explicit consent to sharing Your information with third parties by the Company, for the purposes outlined in this Privacy Policy. In addition, You accept and undertake that Your information may be shared:

1. With Service Providers, Contractors, and Agents: We share Your data with third parties who perform Services on our behalf, like payment processing, data analysis, marketing, and advertising Services (including retargeted advertising), email, and hosting Services, and customer Services and support. These service providers may access Your personal data and are required to use it solely as we direct, to provide our requested Services. With Analytics and Data Enrichment Services: As part of our use of third-party analytics tools, and data enrichment Services, we share certain contact information, Profile Data, System Data, and Usage Data, or de-identified data as needed. De-identified data means data where we’ve removed things like Your name and email address and replaced them with a token ID. This allows these providers to provide analytics services or match Your data with publicly-available database information (including contact and social information from other sources). We do this to communicate with You in a more effective and customized manner.

3. To Administer Promotions and Surveys: We may share Your data as necessary to administer, market, or sponsor promotions and surveys You choose to participate in, in accordance with this Privacy Policy, or the rules of the promotion or survey.

Advertisers may also share with us the data they collect about You. Note that if You are opt-out, You’ll continue to be served generic ads.

5. For Security and Legal Compliance: We may disclose Your data to third parties if we (in our sole discretion) have a good faith belief that the disclosure is:

6. Reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of Casa Lontano, our users, employees, members of the public, or our Services.
7. We may also disclose data about You to our auditors and legal advisors in order to assess our disclosure obligations and rights under this Privacy Policy.

6. During a Change in Control: If Casa Lontano undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution (including bankruptcy), or a sale of all or some of its assets, we may share, disclose, or transfer all of Your data to the successor organization during such transition or in contemplation of a transition (including during due diligence).

7. After Aggregation/De-identification: we can disclose or use aggregate or de-identified data for any purpose.

8. With Your Permission: with Your consent, we may share data with third parties outside the scope of this Privacy Policy.

4. What We Do To Secure Your Information

1. We are actively seeking and taking the most effective and commercially reasonable physical, managerial, and technical safeguards designed to secure Your information from accidental loss and unauthorized access, use, alteration, and disclosure. 

2. Our employees and service providers are under obligations of non-disclosure and confidentiality. We also have our service providers sign data processing agreements, where possible. 

5. We Might Be Required to Retain Some of Your Information

We do not keep Your information we collect and process for the purposes identified in this Privacy Policy for more than is necessary for the specific purpose specified in this Privacy Policy unless we are required to retain that information for a longer period of time to comply with our legal obligations, enforce our legal agreements and policies, and resolve disputes.

We will retain Your information for as long as Your account is active or as needed to provide You with our Services. 10. Intellectual Property

1. All intellectual property rights in the form of content, all materials distributed at or in connection with are owned by Casa Lontano. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Site, in any content, or any materials distributed for any reason without the prior written permission of Casa Lontano.

2. For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in You any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by Casa Lontano or any of its affiliates; nor does this Agreement grant to You any right or license to any other intellectual property rights of Casa Lontano or its affiliates, all of which shall at all times remain the exclusive property of Casa Lontano and its affiliates.

11. Disclaimer of Warranties, Limitation of Liability

We make a reasonable effort to provide accurate information but cannot warrant that any information provided is accurate, complete, reliable, or current. We provide no warranty or assume liability for any information on the Platform. Except as required by law, neither Casa Lontano nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages, or losses arising directly or indirectly from the service or other aspect related thereto or in connection with this Agreement. The Platform shall not be responsible or liable for Orders that are  asnot provided as per the information displayed on the Platform.

12. Cookies

1. Our Casa Lontano Platform and third parties with whom we partner, may use cookies, pixel tags, web beacons, mobile device IDs, “flash cookies” and similar files or technologies to collect and store information with respect to Your use of the Services and third-party websites.

2. Cookies are small files that are stored on Your browser or device by websites, apps, online media, and advertisements. We use cookies and similar technologies for purposes such as:

1. Authenticating users;
2. Remembering user preferences and settings; 
3. Determining the popularity of content; 
4. Delivering and measuring the effectiveness of advertising campaigns; 
5. Analysing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our Services.

3. A pixel tag (also called a web beacon or clear GIF) is a tiny graphic with a unique identifier, embedded invisibly on a webpage (or an online ad or email), and is used to count or track things like activity on a webpage or ad impressions or clicks, as well as to access cookies stored on users’ computers. We use pixel tags to measure the popularity of our various pages, features, and Services. 13. Miscellaneous

1. Casa Lontano’s failure to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder. 

2. Casa Lontano shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Casa Lontano’s reasonable control. 

3. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. 

4. This Agreement is not assignable, transferable, or sub-licensable by You except with Casa Lontano’s prior written consent. 

14. Last But Not Least

1. The Platform may contain links to other sites and applications and the Company does not bear any responsibility for the privacy practices and contents of those sites and applications.

2. The Company may change the provisions of this Privacy Policy by publishing it on the Site at any time. The Company’s amended Privacy Policy provisions become effective on the date when they are posted on the Site.
